Hi Gemma - loved your piece today on Divorce and couldn’t agree with your sentiments heartily enough! Divorce is all to wide an occurrence these days and many will suffer as a result of this having been removed. Proving you are in a domestic violent/abusive relationship in order to qualify will be no picnic either…here’s what the Ministry of Justice say about it and interestingly enough, it speaks about ‘women’ being the ones abused…of course, ‘men’ are abused too…I wonder what their stance on that is…(thinks about making tea and going off to investigate further)…
“If you are a victim of domestic violence and are divorcing or separating from an abusive partner you can get legal aid to help. This can be help with the divorce or things such as child contact or how to share money or property.
To get legal aid you must be able to give your solicitor some evidence that you have been a victim of domestic violence by your partner or husband.
There are many forms of domestic violence and it is not just about physical violence.
Types of evidence:
criminal conviction
police caution
ongoing criminal proceedings
protective injunction
an undertaking
letter from a Multi Agency Risk Assessment Conference
finding of fact, by a court
letter from social services
letter from a GP, doctor, nurse, midwife or healthcare professional
letter from a domestic violence refuge”
I sincerely hope those brave enough to step forward are brave enough to go through this process in order to get the assistance they need.
